These Terms of Service ("Terms") govern your access to and use of the PulseBoard hosted service and website (collectively, the "Service") provided by PulseBoard ("we", "us", or "our"). By creating an account or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
You must be at least 16 years old and capable of forming a binding contract to use the Service. If you are under 18, you must have the consent of a parent or legal guardian.
You are responsible for maintaining the confidentiality of your API keys, bearer tokens, and passwords. You are responsible for all activity that occurs under your account. Notify us immediately at security@pulseboard.cloud if you believe your credentials have been compromised. We will not be liable for any loss arising from unauthorised access due to your failure to protect your credentials.
You must not use the Service to:
We offer a free tier subject to the usage limits described on the pricing page. We may throttle, suspend, or terminate free-tier accounts that materially exceed advertised limits or that show signs of abuse. Paid plans are billed monthly in advance; overage is billed in arrears at the published per-unit rates. You authorise us to charge the payment method on file for all fees due.
You retain full ownership of all metrics, logs, traces, and configuration data you
ingest into the Service. Upon request or within 30 days of account closure we will make
a machine-readable export available via the GET /api/portal/export endpoint.
We will not sell, rent, or share your ingested telemetry data with third parties except
as required to operate the Service (e.g., cloud infrastructure providers under data
processing agreements).
The PulseBoard edge runtime, agent, and libraries are MIT-licensed and available at github.com/OpenPulseBoard. The hosted control-plane software, branding, and documentation are proprietary. Nothing in these Terms grants you a licence to our proprietary materials beyond the right to use the Service as described herein.
We target 99.5% monthly uptime for the hosted ingestion and query API on paid plans. This excludes scheduled maintenance windows (announced at least 24 hours in advance via status.pulseboard.dev) and events beyond our reasonable control. Free-tier users receive no uptime guarantee. Compensation for paid-plan downtime is limited to service credits as described in the SLA addendum available at /docs#sla.
Use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PULSEBOARD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, REVENUE, OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
Either party may terminate these Terms at any time. You may close your account via the portal or by emailing hello@pulseboard.cloud. We may suspend or terminate your account for material breach of these Terms, non-payment, or if we believe your use poses a security risk to other users. Sections 5 (data portability), 6 (intellectual property), 9, 10, and 12 survive termination.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law provisions. Any dispute that cannot be resolved informally shall be submitted to binding arbitration under the JAMS rules, conducted in English, with the seat in Delaware. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
We may update these Terms from time to time. We will post the revised Terms here and, for material changes, send a notification to the primary email address on your account at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
